Keeper liability
Schedule 4 of the Protection of Freedoms Act 2012 lets an operator pursue the keeper only when the Notice to Keeper meets every condition, including timing and the prescribed wording.
Period of parking
ANPR records camera passes. A period of parking is a different thing. Consideration time on arrival and a grace period at the end both sit inside a fair reading of the codes.
Contract and signage
ParkingEye Ltd v Beavis confirmed that a clear charge can be enforceable. It also turns on signs the driver could actually read. Unclear core terms are still a defence.
Landholder authority
The operator has to be entitled to offer parking and to pursue charges on that land. A demand without the contract chain is a proper subject of strict proof.
Payment and permission
A paid session, a failed machine, a patron stay, a permit, or a hotel booking can take the vehicle outside the alleged relevant contract.
BPA, IPC, POPLA, IAS
ParkingEye sits with the British Parking Association, so a rejection should come with a POPLA code. IPC operators use the Independent Appeals Service instead.

Is a PCN a fine?
A council Penalty Charge Notice is a civil penalty under the traffic rules. A private Parking Charge Notice, including a ParkingEye notice, is an invoice for an alleged contract. The letters look similar. The appeal route is not.
Do you have a 75% success rate?
